Insurance Adjusters say they don’t owe to match

My house was recently damaged by Hurricane Ike and I was wondering if someone here might be able to tell me if what my adjuster told me was true.

I had a tree hit my home and then the roof leaked into my home damaging my kitchen cabinetry on one side of my kitchen.

My insurance adjustor told me that they would pay to replace the kitchen cabinets on one side of my kitchen but that the other cabinets were not damaged and so they do not owe us to replace them.

In addition, without the inclusion of the cabinets on the other side of the kitchen my adjuster says that the whole claim is under my 2% deductible

My cabinets are over 25 years old and to only replace one side would look terrible.

Does anyone have any ideas on this?

This is an excellent example of where a good public insurance adjuster is worth their weight in gold. I would consult with a public adjuster to see what they say. Often, they can justify matching cabinetry as well as dispute insurance estimates. You will pay the public adjuster a percentage but I'm guessing you'll get your money's worth.

I've been on both sides of the insurance claim and have worked with many public adjustors who have helped people like you negotiate tricky claims like this.

Yes their is no specific language in the Homeowners policy that provides for matching HOWEVER, presidents in law resulting from the Minn/St Paul hailstorm of 1998 clearly established that gross mismatch is not acceptable and replaced material must be LKQ (like kind and quality).

Based on the information listed in your post I would have to say that your adjuster made the right initial decision HOWEVER, you have two years to prove otherwise. (i.e. it ain't over till it's over) You may not know it but you posess the power to trumph the adjusters decision with more complete and factual information. In other words, the law of who wins will always favor the party who is the most accurate.

EXAMPLE:

"I tried to find replacement cabinets that were of simular LKQ but could find nothing that would anything less that (buzzword) gross mismatch. Therefore, I am enclosing a $8,956.34 PROPOSAL for a custom cabinet maker to fabricate cabinets to the exact specifications of of the cabinets that were damaged."

This approach gives your Insurer little wiggle room other than to simply pay for your proposal unless they want to go through the trouble of providing a better alternative. Fact is that they promised to put your home back together the way it was before the occurance and they are aware that anything less would be a violation of Dept. of Ins. laws.


I am a public adjuster and this is a clear demonstration of how an experience insurance professional can help w/your claim. A good PA is no different than a good tax accountant or attourney in the sence that they can guide you through some pretty tricky waters and save you money as well. The thought that you can handle your claim as effectively as I can is as silly as me stepping into your profession with a simular attitude.
